- Service Estimates: All technical quotes provided via email or written proposal are valid for 30 days from issuance unless specified otherwise.
- Scope Changes: Any request for hardware additions, secondary network cabling, custom web template modifications, or out-of-scope work during an active engagement will require a separate quote approval.
- Diagnostic Audits: Initial hardware and network diagnostics are conducted using industry-standard tools to pinpoint system faults accurately before implementation.
3. Client Responsibilities & Data Backups
To ensure smooth technical execution and service delivery, Clients agree to:
✔ Provide timely, accurate network access details, system administrative credentials, or DNS management records required for deployment.
✔ Maintain independent backups of critical data before scheduled hardware diagnostics, operating system maintenance, or network configuration changes.
✔ Ensure that all hardware and software submitted to us for maintenance are lawfully licensed and legally owned.
4. Intellectual Property Rights
All content on this website—including source code, UI/UX designs, CSS/Tailwind layouts, logos, brand assets, custom Blogger XML templates, and technical documentation—is the exclusive property of Sekoala Bopape / iT-U Company and protected under South African and international copyright laws.
Custom Web Builds: Upon full payment of custom web development fees, clients are granted a non-exclusive, perpetual license to use the final delivered codebase for their specific domain. Proprietary reusable framework components remain our intellectual property.
5. Service Availability & Third-Party Services
While we strive for 100% uptime and seamless technical operation, our digital platform relies on global infrastructure third parties (such as GitHub Pages, HostAfrica, and DNS providers).
- We do not guarantee uninterrupted access to third-party web hosts or cloud server facilities.
- Scheduled maintenance windows, regional power disruptions, or upstream ISP failures are beyond our direct control.
6. Limitation of Liability
To the maximum extent permitted by South African law, Sekoala Bopape and iT-U Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages—including loss of data, loss of revenue, or business interruption—arising out of:
- Use or inability to use this website or technical service tools.
- Hardware failures due to pre-existing component wear, physical damage, or power surges prior to repair.
- Third-party server downtime, DNS propagation delays, or external cyber incidents.
7. Payment Terms & Billing
Invoices for IT services, consultation, and web architecture are payable strictly according to the payment terms stated on official invoices. Failure to settle outstanding balances may result in temporary suspension of hosted web services or technical support access until resolved.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes or claims arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.
